The Operating Rules You Will Use Every Flight

Six rules from Part 107 govern every commercial flight you'll ever fly: altitude, speed, line of sight, weather, right of way, and who's responsible. Learn them cold — they show up on the exam and on every real job.

The hard limits: 400 feet, 100 mph

Part 107 gives you two performance ceilings: 400 feet above ground level (AGL), and 100 mph (87 knots) groundspeed. For the kind of work I do — real estate, coastal footage — you'll rarely bump either one. Most listing shots look best between 100 and 250 feet, and no camera drone I fly cruises anywhere near 87 knots.

There's one useful exception to the altitude cap: you may climb above 400 feet AGL if you stay within 400 feet of a structure, up to 400 feet above its uppermost point. That's what makes tower and tall-building inspections legal. For everyday shoots, treat 400 AGL as the ceiling and plan your shot list around it.

If you can't see it, you can't fly it

Visual line of sight (VLOS) is the rule pilots break most casually — and the one the FAA cares about most. You, the remote pilot, must be able to see the aircraft with your own unaided eyes throughout the flight. Prescription glasses or contacts are fine; binoculars, zoom lenses, and the camera feed on your controller are not.

You can add a visual observer, and on busy shoots you should — extra eyes are cheap insurance. But a VO is help, not a loophole. VLOS is still required even with an observer on the crew. If the drone slips behind a treeline or a rooftop, your job is simple: bring it back into view, now.

You're filming a beachfront listing when your drone drifts behind a tall dune. You can still see it perfectly on your controller screen, and your visual observer on the boardwalk still has eyes on it. What's your situation?

Under 107.31, the remote pilot must be capable of seeing the aircraft with unaided vision — glasses are fine, screens and binoculars are not. A visual observer is optional help, not a substitute: using one doesn't authorize flying somewhere you can't see the drone yourself. And there's no 30-second grace period; that number is invented. Move so you can see it again.

The weather numbers that cancel shoots

Two numbers decide whether a flight happens at all: minimum flight visibility of 3 statute miles, and cloud clearance of 500 feet below and 2,000 feet horizontal. On the Gulf coast, morning fog and low cloud decks fail these minimums more often than new pilots expect — I've pushed plenty of sunrise shoots to mid-morning for exactly this reason.

Notice what the cloud rule really does: it can lower your ceiling. A flat deck sitting at 700 feet AGL means you top out at 200 feet, not 400, because you owe the clouds a 500-foot buffer. Read a METAR before you leave the house, then trust your own eyes when you arrive on site.

Morning shoot on the coast: visibility is a solid 5 miles, but a flat cloud deck sits at 800 feet AGL. How high can you legally take the drone?

You need 500 feet between the drone and the cloud base: 800 minus 500 leaves a 300-foot working ceiling for this flight. The 400-foot rule is a maximum, not a guarantee — weather can shave it lower, which trips up a lot of pilots. Flying to the cloud base leaves zero buffer, and canceling entirely is unnecessary: 5 miles beats the 3 SM visibility minimum, so you fly — just lower.

Manned aircraft fly lower than you think. Crop dusters, medevac helicopters, and aircraft on powerline or pipeline patrol regularly work below 500 feet — right in your operating window. If you hear an engine, look up, find it, and be ready to descend or land immediately.

You're the pilot in command — all of it is on you

Every manned aircraft — a helicopter, a crop duster, a Cessna out on a lazy Sunday — has the right of way over your drone. You yield, every single time, and yielding means staying well clear, not "close enough." A drone loses every argument with an airplane, and so does your certificate.

As remote pilot in command, the FAA holds you directly responsible for the entire operation. That's why 107.49 requires a preflight assessment before every flight: the airspace you're in, the weather, your battery and control links, and the people and structures around your operating area.

None of this is bureaucracy. It's the same habit loop I run before every paid shoot, and it's the reason jobs get done without drama. Fly the numbers, keep it in sight, yield to everything with a person in it, and check your ship before it leaves the ground.
